SkinDoctor's cosmetic doctors are all BIG registered and members of the NVEG.
Article 2 - Applicability
These terms and conditions apply to any transaction established between entrepreneur and consumer through the webshop skindoctor.co.uk.
Article 3 - The agreement
The agreement is concluded at the time of payment by the consumer of the offer, subject to the provisions of paragraph 6 of this article.
The entrepreneur confirms the consumer's payment by e-mail. Until the moment of this confirmation of acceptance by the entrepreneur, the consumer can dissolve the agreement.
The entrepreneur shall take appropriate technical measures to ensure a secure web environment and secure transmission of data and payments.
When the consumer purchases a product or service, Entrepreneur shall digitally make available the following information:
The contact details of the trader's web shop where consumers can go with complaints;
Price including taxes;
Cost of delivery if applicable;
Mode of delivery
Within the limits of the law, the entrepreneur can investigate whether the consumer can meet his payment obligations or whether there are other facts that are important for a responsible conclusion of the agreement. If, based on this investigation, entrepreneur has good grounds not to enter into the agreement, he is entitled to refuse the order or attach special conditions to the implementation.
Article 4 - The offer
If the offer has a limited period of validity or is made under special conditions, this will be explicitly stated by the entrepreneur.
The offer contains a description of the products and/or services offered so that the consumer can assess them properly. If images are used, these are truthful images of the offer.
Mistakes or errors in the offer, where it can be immediately obvious to a consumer that there is a mistake or error, do not bind the entrepreneur.
Article 5 - The price
All prices of products or services offered are prices including VAT. If there are any packaging, shipping or other additional costs, these will be clearly stated with the offer.
The prices of the products and/or services offered will not be changed during the transaction between entrepreneur and consumer due to changes in VAT rates or other changes.
Article 6 - Payment
The amounts owed by the consumer should, unless otherwise agreed, be paid prior to delivery of the good.
Payment can be made by iDeal and Paypal. Credit cards are accepted from VISA, MasterCard and American Express if issued in the Netherlands or Belgium. Credit cards issued in other countries are not accepted.
Article 7 - Right of withdrawal on delivery of products
The consumer has up to fourteen days from the day of receipt of the product to dissolve the agreement without giving reasons. The trader may ask the consumer about the reason for withdrawal, but may not oblige the consumer to give his reason(s).
The period of this reflection period starts on the day after the consumer, or a third party designated in advance by the consumer, who is not the carrier, has received the product, or:
if the consumer has ordered several products in one order: the day on which the consumer, or a third party indicated by him, has received the last product. The trader may, provided he has clearly informed the consumer of this prior to the ordering process, refuse an order of multiple products with different delivery times.
if the delivery of a product consists of several shipments or parts: the day on which the consumer, or a third party designated by him, received the last shipment or part;
for contracts for regular delivery of products during a given period: the day on which the consumer, or a third party designated by him, received the first product.
The risk and burden of proof for the correct and timely exercise of the right of withdrawal lies with the consumer. The consumer bears the direct costs of returning the product. If the trader has not notified the consumer that the consumer has to bear these costs or if the trader indicates to bear the costs himself, the consumer does not have to bear the costs of return shipment.
To exercise the right of withdrawal, the consumer must notify the trader in writing within the withdrawal period by post or by e-mail to info@skindoctor.nl
The consumer returns the product with all delivered accessories in accordance with the reasonable and clear instructions provided by the operator.
If the consumer wishes to exercise the right of withdrawal, the product should, if reasonably possible, still be in its original condition and packaging, unopened, undamaged and still in saleable condition. It shall only unpack or use the product to the extent necessary to establish the nature, characteristics and functioning of the product. The starting point here is that the consumer may only handle and inspect the product as she would be allowed to do in a shop.
Excluded from the right of withdrawal are:
Products that spoil quickly or have a limited shelf life
Sealed products that are not suitable for return for reasons of health protection or hygiene and whose seal has been broken after delivery.
The consumer is only liable for depreciation of the product that results from handling the product beyond what is permitted as described above. The consumer is not liable for depreciation of the product if the trader did not provide him with all legally required information on the right of withdrawal before or at the conclusion of the contract.
Consumer can also use this right of withdrawal if, after opening the product, it turns out that it is of unsound quality. The consumer will notify entrepreneur of these defects in writing or by e-mail no later than 14 days after receiving the product. Entrepreneur will then contact consumer to provide return instructions.
Article 8 - Costs in case of withdrawal
If the consumer exercises the right of withdrawal, at most the cost of return shipment will be borne by the consumer.
Upon withdrawal, the trader will refund the purchase price and any shipping costs to the consumer. This occurs no later than 14 days after the consumer has indicated in writing that he wishes to exercise the right of withdrawal and has returned the goods to the entrepreneur unharmed and in their original packaging.
If consumer has paid shipping costs for the return shipment, these will only be refunded by entrepreneur if one or more products from the shipment are damaged, wrong or otherwise not correctly delivered. If consumer returns the products for any other reason, the shipping costs for the return shipment will be for his own account.
Article 9 - Delivery and execution
When receiving and executing orders for products, the entrepreneur will take the greatest possible care.
If delivery of an ordered product proves to be permanently impossible, the entrepreneur will make every effort to compensate the consumer to his full satisfaction, either by providing a replacement comparable article or by refunding the amount paid. The consumer will be contacted in advance and mutual agreement will be reached.
Unless explicitly agreed otherwise, the risk of loss and/or damage of products rests with the entrepreneur until the moment of delivery to the consumer.
The address that the consumer has communicated to the entrepreneur is considered the place of delivery.
The entrepreneur will execute accepted orders as soon as possible, but at the latest within 10 days, unless a longer delivery period has been agreed. If there is a delay in delivery, or if an order cannot be fulfilled or can only be partially fulfilled, the consumer will be informed about this at the latest within one week after the order was placed. In such a case, a consumer has the right to dissolve the agreement without costs. In that case, trader will refund the amount paid by the consumer as soon as possible, but at the latest within 10 days after dissolution.
Article 10 - Warranty
An arrangement offered as a guarantee by the trader, manufacturer or importer cannot limit or set aside the rights and claims the consumer has against the trader in respect of a shortcoming in the performance of the trader's obligations towards the consumer under the law and/or the distance contract.
Article 11 - Conformity
The entrepreneur guarantees that the products and/or services comply with the agreement, the specifications mentioned in the offer, the reasonable requirements of usability and/or soundness and the existing legal provisions and/or government regulations on the date of the conclusion of the agreement.
Article 12 - Complaints procedure
Consumers have up to and including 14 days from the day of receipt of the product to submit complaints about the execution of the agreement to the entrepreneur fully and clearly described.
The entrepreneur will handle and answer submitted complaints as soon as possible, in any case within a period of 14 days from the date of receipt. If a complaint requires a foreseeably longer processing time, the operator will respond within the 14-day period with a notice of receipt and an indication of when the consumer can expect a more detailed answer.
Article 13 - Additional or different provisions
Additional provisions or provisions deviating from these general terms and conditions may not be to the detriment of the consumer and must be recorded in writing or in such a way that they can be inspected and saved by the consumer in an accessible manner.
Article 14 - Modification of the general terms and conditions
Amendments to these terms and conditions are only effective after they have been properly published. These amendments must have been offered to the consumer for inspection.
Article 15 - Applicable law
Contracts between the entrepreneur and the consumer to which these general terms and conditions relate are exclusively governed by Dutch law.
